Employers are covered by the Federal Fair Labor Standards Act (FLSA), which defines whether an employee is entitled to be paid when a business is closed. If you fall under the status of ?exempt?, as many salaried workers do, you are entitled to be paid. If you are non-exempt, then you are not?although you should still receive a paycheck for hours that you worked prior to Sandy's arrival.

You may be entitled to unemployment benefits.
Residents who are unemployed as a direct result of the storm and who live in of parts of New York, New Jersey and Connecticut that were declared federal disaster areas may be eligible to apply for unemployment assistance. According to the U.S. Department of Labor, anyone unemployed due to Hurricane Sandy is immediately eligible and can submit a claim to the Department of Labor. The criterion for collecting disaster assistance is broader than for collecting regular unemployment benefits.
Specifically, an individual can collect disaster assistance in any of the following cases:
- You are injured in the disaster and unable to work, whether you are an employee or self-employed.
- Your workplace is damaged or destroyed, or you cannot work because of the disaster, or you cannot get to work because you must travel through the affected area, which is impossible due to the disaster.
- You planned to begin working but cannot because of the disaster.
- You derived most of your income from areas affected by the disaster, and your office or business is closed or inoperable because of the disaster.
To apply for unemployment benefits or disaster unemployment assistance, those who were affected by the storm or have lost their job or income should call the Telephone Claims Center (TCC) at 1-888-209-8124, or 1-877-358-5306 if they live outside of New York state.

With media locked on the melodrama involving the ex-CIA director and his biographer ??and now ensnaring other top officials ??the looming fiscal cliff wrangle is receiving less attention than anticipated. That could help.

Both sides have indicated a desire to work together, but the policy preferences between them remain stark, and a deal is far from certain. If they fail to find a solution, the ramifications would be potentially disastrous for the nation's economy.
Under normal circumstances, this kind of high-stakes maneuvering would be the subject of intense media scrutiny, with nonstop cable news coverage, and partisans on both sides trying to gain leverage in the press and behind the scenes.
Instead, what we got this week was a different kind of drama entirely ??one that?s more reminiscent of high school, but that has sucked up virtually all the oxygen in the nation's capital.
We?re referring, of course, to the adultery scandal involving former CIA Director David Petraeus and his biographer, Paula Broadwell ??a mess that has now expanded to ensnare other officials, with the discovery of a trove of apparently inappropriate e-mails between Gen. John Allen, the top US commander in Afghanistan, and another woman, Jill Kelley, who was also on the receiving end of threatening e-mails from Ms. Broadwell.
It has all played out like a real-life episode of ?Homeland,? Showtime?s popular CIA drama. As New York Rep. Peter King (R) commented in a recent television interview: ?It has the elements, in some ways, of a Hollywood movie, or a trashy novel.?
And naturally, it?s the kind of story the chattering class simply cannot resist. That?s primarily because it involves sex, but also because there?s a suspicious timeline (who knew what when) involved. Most important, because of the critical nature of Mr. Petraeus's and General Allen?s positions, it has raised real questions about whether national security might have been put at risk ? or, at least, whether these high-level officials were unduly distracted from their extremely important, taxpayer-funded jobs.
The scandal has created a big, unexpected problem for the president, who now has to scramble to fill two top personnel gaps on his national security team.
But there may be one silver lining: It is, so far, allowing the fiscal cliff maneuverings to proceed with only a fraction of the attention they would otherwise have received. And that may ultimately be more conducive to getting a deal.
As The New York Times?s David Brooks writes Tuesday: ?The liberal left wing, like the Tea Party types, has an incentive to build television ratings by fulminating against their foes. But President Obama and John Boehner have an incentive to create a low-decibel businesslike atmosphere. The opinion-entertainment complex longs for the war track. The practitioners should long for the deal-making track.?
At the moment, this so-called ?opinion-entertainment complex? is currently getting all its entertainment needs (and more) supplied by reports of thousands of apparently inappropriate e-mails sent between Allen and Ms. Kelley, as well as an unnamed FBI agent who was removed from the case for sending shirtless photos of himself to Kelley, and new details on how Petraeus and Broadwell tried to hide their own communications by using a pseudonymous Gmail account in which they drafted, but never sent, racy emails to each other.
And that giant distraction may, in fact, be providing both sides in the fiscal cliff negotiations with an unexpected respite from the spotlight. The issue's not being ignored, of course, and it will likely gain more attention toward the week's end, as Obama and congressional leaders actually sit down together. But for now, the fiscal cliff story is on the back-burner ? and the absence of a media feeding frenzy surrounding the negotiations may be the best thing going for those who hope a deal will actually get done.

I started using online press releases for my websites roughly 2 years ago, and I absolutely love the exposure you can get for your site with them. Below I am going to give you 5 good reasons that you should be submitting press releases often for your business or website at Online PR Media. Make sure you read to the end because I?ve got some bonus tips as well.
#1: PR Helps You Gain Authority
When people are searching for your website or business name and come across articles in the search engines about your business from media outlets, such as ?onlineprmedia.com?, it is going to help your business name become more of an authority. You will see many websites and products use the ?as seen on? logos with mentions of highly recognized media outlets such as ABC, ESPN, or New York Times for example. This is to create that image of authority for the site or product. The same effect can happen when people notice mentions of your business on websites and in press releases.

They visit the press release and see your address listed on the right side of the page, and also have the option about reading more about your business and your story.
Other Tips:
When you are creating a press release at Online PR Media make sure you take advantage of the great options they offer you. They allow you to link back to your own website multiple times, which is must for many of the reasons talked about above. They also allow you to link to your own social media accounts (Twitter and Facebook). Take advantage of that and allow potential customers connect with you via social media. And lastly be sure to include an iframe link to your website so that it will show up beneath your press release, sending even more traffic and potential customers to your business. Lastly, after your press release is live go ahead and link to it, tweet it, or link to it in your Facebook status. The more eyes on your press release the better.

The Flame Virus sent shudders throughout the fields dealing with private and sensitive information, causing clients to take their information from online backup services and use offline hard drives. Though the virus was more worrisome than your average, garden-variety bug, a lot of that worry was for naught. Jay-Z & Coldplay To Rock New York's Barclays Center On New ...
Jay-Z will be joining his British pals?Coldplay for a co-headlining show to ring in the new year at Brooklyn?s Barclays Center on December 31.?The two superstar acts have collaborated in the studio and have teamed up on stage twice before ? once for a New Year?s Eve show in Las Vegas in 2010, and more recently at the 2012 Paralympic Games Closing Ceremony, along with Rihanna. Coldplay is also headlining the NYC venue sans Jay-Z the night before, December 30. For Jay-Z, it?ll be his first time performing at the arena since christening it with an eight-show run that began in late September.

Deadly blast devastates Indianapolis neighborhood
INDIANAPOLIS (AP) ? Splintered beams and boards on a piece of charred earth were all that remained Sunday where at least two Indianapolis homes were leveled in a blast that killed two people and rendered homes for blocks uninhabitable.
A backhoe raked through the rubble in the middle-class subdivision as clusters of firefighters and rescue workers weary from a long, chaotic day that began late the night before waited for their next assignment.
The two-story, brick-faced homes on either side of those demolished by the blast were ruins. One home's roof was gone, a blackened husk left behind. On the other side of the gap, the side of a home was sheared off. Across the street, garage doors had buckled from the heat.
It wasn't yet clear what caused the blast that shook the neighborhood at 11 p.m. Saturday. Residents described hearing a loud boom that blew out windows and collapsed ceilings. Some thought a plane had crashed or that it was an earthquake.
Alex Pflanzer, who was asleep when the nearby homes were leveled, said he heard his wife screaming and thought someone was breaking in his house. Grabbing his gun, he checked the house and saw the front door was standing open.
"I walked outside and all the houses were on fire," he said.
Pflanzer, his wife and two dogs were staying in a hotel room Sunday night. They were, however, without their cat, who refused to budge from the crawl space.
Deputy Code Enforcement Director Adam Collins said as many as 31 homes were damaged so badly that they may have to be demolished. The explosion damaged a total of 80 homes, he said. He estimated the damage at $3.6 million.
Some residents were allowed to return to their homes to retrieve a few belongings Sunday under police escort, officials said. Others whose homes weren't as badly damaged were allowed to go home, but officials said they would have to do without electricity overnight.
Officials did not identify the two people who were killed. However, a candlelight vigil was held at Greenwood's Southwest Elementary School on Sunday night for second-grade teacher Jennifer Longworth. She and her husband, John Dion Longworth, lived at a home destroyed in the blast. WTHR-TV reported that friends, family and colleagues of the teacher gathered at the school.
Deputy Fire Chief Kenny Bacon told reporters Sunday investigators haven't eliminated any possible causes for the blast. But U.S. Rep. Andre Carson, who represents the area, said he had been told a bomb or meth lab explosion had been ruled out.
Bacon said the crisis could have been much worse. "I know we're very fortunate that some of the people weren't home," he said.
Bryan and Trina McClellan were at home with their 23-year-old son, Eric, when the shock wave from the blast a block away shook their home. It knocked out the windows along one side of their house, and their first instinct was to check on their grandchildren, two toddlers who were in the basement. One held his ears and said, "Loud noise, loud noise."
Eric McClellan said he ran to the scene of the explosion and saw homes flat or nearly so.
"Somebody was trapped inside one of the houses, and the firefighters were trying to get to him. I don't know if he survived," he said, adding that firefighters ordered him to leave the area.
Once the flames were out, firefighters went through what was left of the neighborhood, one home at a time, in case people had been left behind, Fire Lt. Bonnie Hensley said. They used search lights until dawn as they peered into the ruined buildings.
Along with the two people killed, seven people were taken to a hospital with injuries, Bacon said. Everyone else was accounted for, he said.
Four of the seven who were injured had minor injuries, fire officials said.
Dan Considine, a spokesman for Citizens Energy, said the utility had not received any calls from people smelling natural gas in that area.
"Most of the time, when there's a gas leak, people smell it," he said. "But not always."
Carson said officials from the National Transportation Safety Board and the federal Department of Transportation, which have oversight over pipelines, were also sending investigators.
Dan Able, a 58-year-old state employee who lives across the street from the two homes that exploded, said his first thought was that a plane had hit his house.
The blast was "a sound I've never heard before, it was so loud," he said. His windows blew out and a bedroom ceiling collapsed on his wife, Jan. He pulled her out, and they went outside.
"Both houses across the street were on fire, basically, just rubble on fire," he said.
The Ables and about 200 other people evacuated from the neighborhood were taken to a nearby school. Some who had been sleeping arrived in their pajamas with pets they scooped up as they fled. Others had to leave their animals behind, and police said later in the day that they were trying to round up those wandering through the area and find their owners.
Most evacuees eventually left the school to stay with relatives, friends or at hotels.
The relief operation was later moved to a church just a few blocks away, where residents could find supplies including blankets, shoes, diapers, canned goods and even a teddy bear.

A recent decision by New York?s highest court highlights the value of spelling out the terms of employment in a written offer letter.
In Ryan v. Kellogg Partners Insti?tu?tional Services (No. 37, NY Court of Appeals, 2012), the New York Court of Appeals upheld an award of $380,000 for an unpaid wage claim and attorneys? fees, principally because the jury believed the plaintiff?s testimony that he was promised a $175,000 bonus by the defendant?s managing partner. That was despite the managing partner?s testimony that he made no such promise.
Neither Kellogg Partners? ?employment-at-will policy and disclaimers, nor the Statute of Frauds provided a defense to the claim.
A properly drafted employment offer letter, which was missing here, would have made all the difference in the result.

The people have spoken. Voters have passed Initiative 502 and beginning December 6th,?state law no longer prohibits production and sale of marijuana. Under state law adults over 21 years old may possess up to an ounce of marijuana (or 16 ounces of solid marijuana-infused product, like cookies, or 72 ounces of infused liquid, like oil) for personal use.
Marijuana has existed in a grey area in Seattle for some time now. Despite a longstanding national prohibition on marijuana, minor marijuana possession has been the lowest enforcement priority for the Seattle Police Department since Seattle voters passed Initiative 75 in 2003. Officers don?t like grey areas in the law. I-502 now gives them more clarity.
Marijuana legalization creates some challenges for the Seattle Police Department, but SPD is already working to respond to these issues head on, by doing things like reviewing SPD?s hiring practices for police officers to address now-legal marijuana usage by prospective officers, as well as current employees.
While I-502 has decriminalized marijuana possession in Washington, the new state law is in direct conflict with federal law, which classifies marijuana as a Schedule I narcotic. All Seattle Police officers have taken an oath to uphold not only state law, but federal law as well. However, SPD officers will follow state law, and will no longer make arrests for marijuana possession as defined under I-502.
The Seattle Police Department and Mayor Mike McGinn have already begun working with state officials to navigate this conflict, and follow the direction of Washington voters to legalize marijuana.
In the meantime, the Seattle Police Department will continue to enforce unlicensed sale or production of marijuana, and regulations against driving under the influence of marijuana, which remain illegal.

Can I legally carry around an ounce of marijuana?
According to the recently passed initiative, beginning December 6th, adults over the age of 21 will be able to carry up to an ounce of marijuana for personal use. Please note that the initiative says it ?is unlawful to open a package containing marijuana?in view of the general public,? so there?s that. Also, you probably shouldn?t bring pot with you to the federal courthouse (or any other federal property).
Well, where can I legally buy pot, then?
The Washington State Liquor Control Board is working to establish guidelines for the sale and distribution of marijuana. The WSLCB has until December 1, 2013 to finalize those rules.
Can I grow marijuana in my home and sell it to my friends, family, and co-workers?
Under state law, as long as you?re a licensed grower and seller, yes. If you?re a medical marijuana patient, the rules on growing haven?t changed.
Can I smoke pot outside my home? Like at a park, magic show, or the Bite of Seattle?
Much like having an open container of alcohol in public, doing so could result in a civil infraction?like a ticket?but not arrest. You can certainly use marijuana in the privacy of your own home. Additionally, if smoking a cigarette isn?t allowed where you are (say, inside an apartment building or flammable chemical factory), smoking marijuana isn?t allowed there either.
Will police officers be able to smoke marijuana?
As of right now, no. This is still a very complicated issue.
If I apply for a job at the Seattle Police Department, will past (or current) marijuana use be held against me? The current standard for applicants is that they have not used marijuana in the previous three years. In light of I-502, the department is consulting with the city?s employment law division and the state attorney general to see if and how that standard may be revised.
What happens if I get pulled over and an officer thinks I?ve been smoking pot?
If an officer believes you?re driving under the influence of anything, they will conduct a field sobriety test and may consult with a drug recognition expert. If officers establish probable cause, they will bring you to a precinct and ask your permission to draw your blood for testing. If officers have reason to believe you?re under the influence of something, they can get a warrant for a blood draw from a judge. If you?re in a serious accident, then a blood draw will be mandatory.
What happens if I get pulled over and I?m sober, but an officer or his K9 buddy smells the ounce of Super Skunk I?ve got in my trunk?
Under state law, officers have to develop probable cause to search a closed or locked container. Each case stands on its own, but the smell of pot alone will not be reason to search a vehicle. If officers have information that you?re trafficking, producing or delivering marijuana in violation of state law, they can get a warrant to search your vehicle.
SPD seized a bunch of my marijuana before I-502 passed. Can I have it back?
No.
Will SPD assist federal law enforcement in investigations of marijuana users or marijuana-related businesses, which are legal, at the state level, under I-502?
No. Officers and detectives will not participate in an investigation of anything that?s allowed by state law.
December 6th?seems like a really long ways away. What happens if I get caught with marijuana before then? Hold your breath. ?Your case will be processed under current state statute. However, there is already a city statute making marijuana enforcement the lowest law enforcement priority.
I?m under 21. What happens if I get caught smoking pot?
It?s a violation of state law. It?ll be referred to prosecutors, just like if you were a minor in possession of alcohol. But, again, marijuana enforcement is still the lowest law enforcement priority in Seattle. This is all still under review and we?re still awaiting advisement from the state attorney general.

Assad: There is no civil war in Syria
BEIRUT (AP) ? Syria's president said in an interview broadcast Friday that his country is not in a state of civil war, and that he has no regrets about any decisions he has made since the uprising against him began nearly 20 months ago.
Instead of civil war, Assad said, Syria is facing "terrorism through proxies," referring to foreign backing of the rebellion against his regime.
In a sign of relentless ferocity of the conflict, a surge of more than 5,000 Syrians crossed into Turkey overnight to flee violence, a Turkish official at the government's crisis management center said Friday. The new exodus raises to 120,000 the number of Syrian refugees in Turkey, said the official, who spoke on condition of anonymity in line with government rules.
Syria's uprising began in March 2011 as mostly peaceful protests against Assad's rule, but as rebels took up arms in the face of a bloody repression of the protests, the conflict morphed into a civil war. The fighting has taken on grim sectarian tones, with the predominantly Sunni rebels battling government forces loyal to a regime dominated by minority Alawites, an offshoot of Shiite Islam.
Anti-government activists say more than 36,000 people have been killed for far, including thousands of government troops. Several hundred thousand Syrians have fled to Jordan, Turkey, Egypt, Lebanon and Iraq.
"We do not have a civil war," Assad said in the interview with the English-language Russia Today TV. "It is about terrorism and the support coming from abroad to terrorists to destabilize Syria. This is our war."
"It is a new kind of war; terrorism through proxies, either Syrians living in Syria or foreign fighters coming from abroad," Assad said. "So, it is a new style of war, this is first and you have to adapt to this style and it takes time, it is not easy."
He acknowledged his troops are fighting a "tough war and a difficult war," adding that when foreign countries stop sending arms to rebels, "I can tell (you) that in weeks we can finish everything."
Asked if he has any regrets, he said: "Not now," although he acknowledged that "when everything is clear" it would be normal to find some mistakes.
Assad spoke in English in the interview that was broadcast in full on Friday. In an excerpt aired a day earlier, Assad said he will "live and die" in Syria and will not leave his country.
Sophie Shevarnadze, the journalist who conducted the 26-minute interview, said during the broadcast that she met Assad in a "newly renovated" presidential palace in Damascus.
She added that she spoke with Assad for about 15 minutes before the interview started and he told her that his three children still go to public schools in Damascus. She added that his British-born wife, Asma, is in Syria as well.
Shevarnadze quoted Assad as telling her that he is a young man who loves sports and life and "I could have just picked up and left like Ben Ali did," referring to former Tunisian President Zine El Abidine Ben Ali, who left to Saudi Arabia in January last year weeks after protests against his regime began.
The Tunisian uprising sparked protests throughout several Arab and led to the removal of long-serving leaders in Egypt, Libya and Yemen.
Assad hinted he will stay in his post until at least 2014 when presidential elections are scheduled to take place. "I think for the president to stay or leave is a popular issue."
Assad came to power after his father, Hafez, died in 2000.
Parliament quickly lowered the presidential age requirement from 40 to 34 so that the ruling Baath party could nominate Bashar Assad. His appointment was sealed by a nationwide referendum, in which he was the only candidate.
He is currently serving his second seven-year term, but a new constitution allows him to run again at least twice.
A new constitution that was approved in a referendum earlier this year opens the way for other candidates to run for presidency. It also imposes a limit of two seven-year terms on the president, meaning Assad could remain legally in power through 2028.
Most Syrian opposition groups and rebels say they will not accept anything less than Assad's departure.
